The claim of no one knowing is false at best, but with that said if drywall was installed at what point did it begin to off gas.The pollution exclusion is only an insurance company defense stragegy. Why this is problematic is you can have homes built in a time frame that are not contaminated. The drywall served its fuction in every way even in contaminated homes.Any one looking at the drywall would say it is drywall and there would be no difference. What muddies the water is the fact that it was installed by contracters and builders alike for a long period of time and they knew it was defective. Contrary to belief if it was relavent to the building industry in 2006 most those in the industry were sweeping it under the carpet as the housing industry flourished. In light of the fact that no government agency could muster a solution then or now one can draw to conclusion many in the industry were going to lose alot of money including the banks who underwrote mortgages on properties that were going to become Toxic assets on their books when people walked away. So one can draw to the conclusion in 2006 when those who were in the know had information that save many from diaster at the expense of the homeowners of CDW properties. If you were a bank, builder,or contractor in the buiding indusrty and seen the hand writting on the wall wouldn't you want to get out with your shirt on your back knowing that this had gone on so long that it could have encompassed 10 years worth of constuction. Take a look at the large builders who allowed for the selling of contaminated homes because they were new and the hidden defect was in their favor no one could see it. Perfect scam perpetrated by those who could and would feed on society for their bottom line profit.
